Welcome to Azad Chouhan. These terms and conditions outline the rules and regulations for the use of Azad Chouhan's Website, located at azadchouhan.in, and the digital services (Web Design, SEO, Paid Ads, Video Editing) provided by us.

By accessing this website and enlisting our services, we assume you accept these terms and conditions in full. Do not continue to use Azad Chouhan's website or services if you do not agree to take all of the terms and conditions stated on this page.

1. Service Agreements & Scope of Work

All projects (including Website Design, Social Media Marketing, SEO, and Ad Management) will be clearly outlined in a custom proposal, invoice, or email agreement prior to the commencement of any work. The scope of work dictates exactly what is included in the price. Any additional features, extra revisions, or services requested outside of the initial agreed scope will be billed separately at an hourly rate or as a new project phase.

2. Client Responsibilities

To ensure timely delivery of your project, you agree to provide necessary assets (such as logos, brand guidelines, text copy, images, and access to accounts like domain registrars or Facebook Business Manager) promptly. Delays in providing these materials or feedback may result in corresponding delays to the project timeline, for which we cannot be held responsible.

3. Payment Terms

  • Upfront Deposits: Web design and video editing projects typically require a non-refundable upfront deposit (usually 50%) before any work begins.
  • Retainers: Ongoing services like SEO and Meta/Google Ads management are billed on a recurring monthly retainer, payable in advance of the month's work.
  • Final Payment: Final project files or website launches will only take place once the remaining balance has been paid in full.

4. Revisions and Approvals

We build our projects with your input at every step. Web design and video editing projects include a specified number of revision rounds (as stated in your proposal). Once a design phase is approved, returning to change it later in the development process may incur additional charges. "Scope creep" will be identified and communicated before proceeding with extra billing.

5. Intellectual Property Rights

Upon final payment, you own the final product (the website code, the edited video, etc.). However, we retain the right to showcase the completed work in our digital portfolio, case studies, and social media for promotional purposes, unless a strict Non-Disclosure Agreement (NDA) has been signed.

6. Limitations of Liability for Marketing

While we use industry best practices for SEO and Paid Advertising, search engine algorithms (like Google's) and ad platforms (like Meta) are controlled by third parties. Therefore:

  • We cannot guarantee specific search engine rankings or exact positions, as algorithms change constantly.
  • We cannot guarantee exact sales volumes or lead numbers from paid advertising campaigns. Our goal is to maximize your ROI, but market conditions, product pricing, and user behavior play a major role in conversions.
  • Azad Chouhan shall not be held liable for any indirect, special, or consequential damages arising out of the performance of our digital marketing services.

7. Termination of Services

Either party may terminate an ongoing monthly service (like SEO or Ads management) with a written notice (typically 15 to 30 days, as specified in your agreement). In the event of project cancellation before completion, the client will be billed for the work completed up to that date, and the initial deposit remains non-refundable.

8. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of India. Any disputes relating to these terms and conditions will be subject to the exclusive jurisdiction of the courts of Sahibzada Ajit Singh Nagar (Mohali), Punjab, India.
